OMG Jump - Terms and Conditions of Sale

1. GENERAL TERMS

All inflatable products, accessories, and related items sold by OMG Jump ("Seller") are subject to the following Terms and Conditions of Sale ("Terms"). By placing an order, the purchaser ("Buyer") agrees to be legally bound by these Terms. No representative, agent, or employee of the Seller is authorized to modify, waive, or alter any provision of these Terms unless expressly agreed to in writing and signed by an authorized officer of OMG Jump.

2. ORDER POLICY

• 2.1 All products are sold on a first-come, first-served basis. Availability is not guaranteed until payment or deposit is received.
• 2.2 For in-stock items, orders must be paid in full and are subject to immediate shipment unless a different arrangement has been agreed upon in writing by Seller.
• 2.3 A non-refundable deposit of thirty percent (30%) is required to reserve production space for standard orders. A deposit of fifty percent (50%) is required for custom or made-to-order products.
• 2.4 Orders without a deposit will not be scheduled for production. Production timelines and estimated ship dates begin only after the required deposit has been received.

3. CANCELLATION POLICY

• 3.1 Orders may be cancelled within forty-eight (48) hours of placement or prior to shipment, whichever comes first, by providing written notice to the Seller.
• 3.2 Cancellations of standard items made after the forty-eight (48) hour window, but before shipment, are subject to a restocking fee equal to thirty percent (30%) of the total purchase price.
• 3.3 Once an order has shipped, it is no longer eligible for cancellation, refund, or credit. The Seller does not cover or refund any shipping costs for cancelled or refused shipments.
• 3.4 All custom orders are final, non-cancellable, and non-refundable. Deposits made on custom orders will be forfeited if the order is cancelled at any time.

4. PAYMENT TERMS

• 4.1 The final balance must be paid in full no later than forty-eight (48) hours prior to the scheduled shipment date.
• 4.2 Accepted payment methods include Zelle, wire transfer, cash, or an approved credit card. All payments must clear before shipment is released.
• 4.3 OMG Jump reserves the right to withhold or delay production and/or shipment if payment obligations are not fulfilled in full and on time.
• 4.4 The Buyer is solely responsible for tracking payment deadlines. The Seller is under no obligation to send reminders or notices regarding upcoming payment due dates.

5. SHIPPING & DELIVERY

• 5.1 All shipments are made F.O.B. Los Angeles, California. Title and risk of loss transfer to the Buyer upon delivery to the carrier.
• 5.2 Shipping dates provided by OMG Jump are estimates only and are not guaranteed. OMG Jump is not liable for any delays caused by freight carriers, weather conditions, labor strikes, government actions, or acts of God.
• 5.3 The Buyer may request a preferred freight carrier. If no carrier is specified, OMG Jump will select one at its sole discretion.
• 5.4 The Buyer must inspect all goods immediately upon delivery. Any claims for shortages, damage, or defects must be submitted in writing to OMG Jump within five (5) calendar days of delivery.
• 5.5 All risk of loss during transit is the responsibility of the Buyer. It is the Buyer’s responsibility to obtain shipping insurance if desired.
• 5.6 OMG Jump does not cover or reimburse any shipping costs related to delays, returns, refunds, or warranty claims. All such costs are the sole responsibility of the Buyer.

6. INSPECTION & ACCEPTANCE

• 6.1 The Buyer must inspect all goods immediately upon receipt. Any claims for visible defects, shortages, or non-conforming products must be submitted to the Seller in writing within five (5) calendar days of delivery.
• 6.2 Failure to notify the Seller in writing within the specified inspection period will constitute a waiver of any such claims and will be deemed full acceptance of the goods in their delivered condition.
• 6.3 If any damage occurs during transit, the Buyer must document the damage at the time of delivery with the freight carrier. Visible damage must be noted on the shipping receipt before the driver leaves. Photos are strongly recommended.

7. WARRANTY

• 7.1 OMG Jump offers a limited warranty for manufacturing defects as follows:
  • (a) Two (2) years for inflatable bounce houses
  • (b) One (1) year for water slides and inflatable games
  • (c) Ninety (90) days for zippers, mesh, entrance covers, slide mats, and similar accessories
• 7.2 Warranty does not cover fading, color variations, wear and tear, misuse, improper storage/setup, or unauthorized repairs.
• 7.3 All warranty repairs must be pre-approved and completed at OMG Jump's facility in Los Angeles. The Buyer covers inbound shipping costs.
• 7.4 No replacement units will be provided during repairs. OMG Jump is not liable for missed income or business disruptions.
• 7.5 Blowers are only covered under their original manufacturer's warranty.
• 7.6 Third-party products are covered only by the original manufacturer's warranty. OMG Jump assumes no additional liability.

8. LIMITATION OF LIABILITY

• 8.1 OMG Jump is not liable for special, incidental, or consequential damages including lost income or business interruption.
• 8.2 OMG Jump’s maximum liability shall not exceed the product’s purchase price.

9. TAXES AND DUTIES

The Buyer is responsible for all applicable sales taxes, fees, and duties related to their purchase. OMG Jump only ships within the United States.

10. INTELLECTUAL PROPERTY

All logos, designs, images, and marketing materials are the sole property of OMG Jump. Unauthorized use is strictly prohibited.

11. INDEMNIFICATION

The Buyer agrees to indemnify and hold harmless OMG Jump from any claims arising from the use, misuse, or resale of the products.

12. INSURANCE REQUIREMENT

The Buyer must maintain general liability insurance of at least $1,000,000 per occurrence covering all products purchased.

13. RETURN POLICY

• 13.1 All sales are final. No returns or exchanges unless the item is damaged at the time of purchase.
• 13.2 Damage must be reported within five (5) days of delivery.
• 13.3 All cancellations are subject to a 30% restocking fee. Custom orders are non-refundable.

14. FORCE MAJEURE

OMG Jump is not liable for delays or failures caused by unforeseen events beyond its control, such as natural disasters, labor strikes, or government actions.

15. GOVERNING LAW & VENUE

This agreement is governed by California law. All disputes must be resolved in Los Angeles County, California.

16. LEGAL FEES

The prevailing party in any legal action is entitled to recover attorneys’ fees and legal costs.

17. SEVERABILITY

If any provision is found unenforceable, the remaining sections will still apply in full force.

18. ENTIRE AGREEMENT

These Terms constitute the full agreement between OMG Jump and the Buyer, superseding all prior communications.

19. RIGHT TO REFUSE SERVICE

OMG Jump reserves the right to refuse service or cancel orders at its discretion without liability.
