Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") apply to all products, merchandise, equipment, accessories, replacement parts, custom products, and related items sold or provided by OMG Jump Inc. ("OMG Jump," "Seller," "we," "us," or "our").

The person or business purchasing from OMG Jump is referred to as the "Buyer" or "Customer".

By placing an order, signing or paying an invoice, paying a deposit, completing an online purchase, accepting delivery, or taking possession of merchandise, the Buyer acknowledges that the Buyer has read, understood, and agreed to these Terms.

No employee, sales representative, or other person may modify or waive these Terms unless the change is approved in writing by an authorized representative of OMG Jump.

Warranty coverage applies only to the products and components specifically identified in Section 7.

The version of these Terms in effect when the order is placed will govern that transaction.

1. GENERAL TERMS

1.1 Scope

These Terms apply to purchases made through the OMG Jump website, store, warehouse, telephone, email, text message, invoice, purchase order, financing transaction, or any other accepted sales method.

1.2 Commercial Products

Many OMG Jump products are commercial event-equipment products intended for party-rental businesses and other commercial operators.

The Buyer is responsible for determining whether a product is suitable for the Buyer’s intended use.

1.3 Buyer Authority

A person placing an order for a company, organization, partnership, or other entity represents that the person has authority to bind that entity to these Terms.

1.4 Product Information

Product photographs, videos, descriptions, colors, measurements, capacities, weights, and specifications are provided for general reference.

Minor variations may occur because of manufacturing processes, screen settings, materials, production batches, or product improvements. Variations that do not materially interfere with normal intended use are not considered defects.

2. ORDER POLICY

2.1 Product Availability

Products are sold on a first-come, first-served basis.

Merchandise is not reserved until OMG Jump receives the required payment or deposit and confirms the order. A quotation, draft invoice, shopping cart, or verbal discussion does not reserve merchandise.

2.2 Payment Before Release

Unless OMG Jump approves another arrangement in writing, in-stock products must be paid in full before pickup, delivery, shipment, or release.

2.3 Deposits

A thirty-percent (30%) deposit is generally required to reserve standard merchandise, production space, or incoming inventory.

A fifty-percent (50%) deposit may be required for custom, personalized, specially manufactured, or made-to-order products.

A different deposit amount may apply when stated on the invoice or order agreement.

2.4 Production Scheduling

Production will not be scheduled until OMG Jump receives:

1. The required deposit;

2. Final product selections;

3. Approved artwork or customization instructions, when applicable; and

4. Any additional information required to begin production.

Estimated production times begin only after all required items are received.

2.5 Order Changes

Order changes are not guaranteed.

An approved change may affect the price, availability, production schedule, shipping cost, and estimated completion date. OMG Jump may require payment of additional costs before beginning the change.

2.6 Pricing and Listing Errors

OMG Jump may correct pricing, description, inventory, typographical, or listing errors.

If an error materially affects an order, OMG Jump may cancel the affected portion and refund amounts paid for merchandise that will not be provided.

2.7 Custom-Product Variations

Custom and made-to-order products may vary slightly from samples, photographs, mockups, drawings, or digital renderings.

Reasonable manufacturing, material, and color variations are not considered defects.

2.8 Pickup Deadline

Unless otherwise agreed in writing, orders must be picked up within seven (7) calendar days after payment and confirmation that the order is ready for pickup.

2.9 Orders Not Picked Up

Because of limited warehouse space and product demand, merchandise not picked up within seven (7) calendar days may be released back into available inventory.

Before picking up after the seven-day period, the Buyer must contact OMG Jump to confirm availability.

If the merchandise is no longer available, the Buyer agrees to wait until the same or comparable merchandise becomes available through the next shipment or restock. Any payment already made will remain credited toward the Buyer’s order.

3. CANCELLATION AND DEPOSIT POLICY

3.1 Cancellation Requests

Cancellation requests must be submitted in writing.

A cancellation is not approved until confirmed by OMG Jump in writing.

3.2 Cancellation Within 48 Hours

OMG Jump may accept a cancellation request made within forty-eight (48) hours after the order was placed if:

1. The merchandise remains in OMG Jump’s possession;

2. The merchandise has not been picked up, delivered, shipped, or released to a freight carrier; and

3. Production or customization of a custom or made-to-order product has not begun.

3.3 Nonrefundable Deposits

After forty-eight (48) hours, all deposits become nonrefundable, even if the merchandise remains in OMG Jump’s possession and has not been picked up or shipped.

A custom or made-to-order deposit becomes nonrefundable once production, design, customization, material preparation, or special ordering begins, even if fewer than forty-eight (48) hours have passed.

3.4 Paid-in-Full Standard Orders

A paid-in-full standard order cancelled after forty-eight (48) hours but before pickup, delivery, shipment, or release to a freight carrier may be accepted only at OMG Jump’s discretion.

An approved cancellation is subject to a cancellation or restocking fee equal to thirty percent (30%) of the total order amount.

3.5 Orders Already Released

An order cannot be cancelled after it has been picked up, released to the Buyer or the Buyer’s representative, loaded into the Buyer’s vehicle, delivered locally, transferred to a freight carrier, or shipped.

3.6 Refused Shipments

Refusing delivery does not constitute an approved cancellation or return.

The Buyer remains responsible for the order, original shipping charges, return freight, redelivery, storage, carrier fees, and other resulting expenses.

4. PAYMENT TERMS

4.1 Final Payment

Unless another written arrangement is approved, the remaining balance must be paid in full no later than forty-eight (48) hours before the scheduled pickup, delivery, or shipment date.

4.2 Cleared Funds

Payments must clear before merchandise is released. OMG Jump may hold an order until payment is verified.

4.3 Payment Methods

Accepted payment methods may include cash, Zelle, wire transfer, approved credit or debit cards, Shop Pay, approved third-party financing, or another method accepted by OMG Jump.

Available methods may vary based on the order, amount, location, and risk assessment.

4.4 Payment Delays

OMG Jump may delay production, pickup, delivery, or shipment when payment obligations are not satisfied on time.

A delay caused by the Buyer’s failure to pay does not make the order or deposit refundable.

4.5 Third-Party Financing

Financing is provided by independent third parties.

OMG Jump is not a lender and does not control financing approval, interest rates, payment amounts, credit limits, loan terms, late fees, credit reporting, or lender decisions.

If financing is denied, suspended, reversed, or cancelled, the Buyer remains responsible for all unpaid amounts.

4.6 Fraud Prevention

OMG Jump may request identification, payment authorization, matching billing information, business records, or other verification before releasing an order.

OMG Jump may delay or cancel an order when fraud, identity theft, unauthorized payment, or suspicious activity is reasonably suspected.

5. SHIPPING AND DELIVERY

5.1 F.O.B. Shipping Terms

Unless otherwise agreed in writing, shipments are made F.O.B. Los Angeles, California.

Title and risk of loss transfer to the Buyer when the merchandise is delivered to the freight carrier.

5.2 Estimated Dates

Production, shipping, arrival, and delivery dates are estimates and are not guaranteed.

OMG Jump is not responsible for delays caused by carriers, manufacturers, suppliers, customs, ports, weather, traffic, labor disputes, government actions, equipment failures, supply-chain interruptions, or other circumstances beyond its reasonable control.

5.3 Freight Carriers

The Buyer may request a preferred freight carrier. Otherwise, OMG Jump may select a carrier on the Buyer’s behalf.

Selecting or arranging a carrier does not make OMG Jump responsible for the carrier’s delays, actions, losses, or damage.

5.4 Freight Quotes and Additional Charges

Freight quotes are estimates based on the information available when prepared.

The Buyer is responsible for additional carrier charges, including residential delivery, liftgate service, limited-access delivery, appointments, inside delivery, reclassification, reweighing, redelivery, detention, storage, address corrections, or refused shipments.

5.5 Shipping Insurance

Shipping insurance is not included unless expressly stated in writing.

The Buyer is responsible for requesting and purchasing shipping insurance when desired and available.

5.6 Delivery Inspection

The Buyer or the Buyer’s representative must inspect the shipment before signing the delivery receipt.

The Buyer must count the pallets, boxes, packages, and pieces and inspect the merchandise and packaging for visible damage, shortages, punctures, crushing, tears, broken bands, leaning pallets, or water exposure.

Visible problems must be specifically written on the carrier’s delivery receipt before the driver leaves. Writing only "subject to inspection" may not adequately document a freight claim.

The Buyer should photograph the complete shipment, packaging, damaged areas, shipping labels, freight truck, and signed delivery receipt.

5.7 Reporting Transit Damage

Transit damage must be reported to OMG Jump in writing within five (5) calendar days after delivery.

The report must include the order or invoice number, a description of the damage, photographs or videos, the signed delivery receipt, and any requested carrier documents.

Transit damage is not a manufacturing warranty claim.

5.8 Transit-Damage Resolution

OMG Jump will review properly documented transit damage and help determine an appropriate solution.

Depending on the circumstances, the solution may include assistance with a carrier claim, repair instructions, a replacement component, an authorized repair, an approved exchange, or another commercially reasonable solution selected by OMG Jump.

Reporting damage does not authorize the Buyer to refuse delivery or return the entire product.

The solution may not require the product to be shipped back.

5.9 Unauthorized Returns and Shipping Costs

No merchandise may be refused, returned, shipped back, or delivered to OMG Jump without prior written authorization.

Unless OMG Jump agrees otherwise in writing, the Buyer is responsible for freight, shipping, packaging, palletizing, insurance, handling, loading, unloading, storage, redelivery, and return transportation expenses.

5.10 Shipment Scheduling

Unless otherwise agreed in writing, orders containing merchandise currently in stock will be scheduled for shipment after payment has cleared and all required shipping information has been received.

Carrier pickup, transit, and delivery dates are estimates and are not guaranteed.

Freight rates are subject to change and are not guaranteed until the order is finalized and the shipment is scheduled or booked with the carrier.

6. INSPECTION AND ACCEPTANCE

6.1 Customer Pickup

A Buyer picking up merchandise must inspect the order before it is loaded and before leaving OMG Jump’s property.

The Buyer is responsible for confirming the product, quantity, color, size, visible condition, and included components.

6.2 Authorized Representatives

Release to the Buyer’s employee, driver, family member, transporter, freight company, or other authorized representative is considered release to the Buyer.

6.3 Final Acceptance

Once merchandise is released, loaded, and removed from OMG Jump’s property, the sale is final, subject only to the applicable transit-damage, defect, exchange, and warranty provisions in these Terms.

6.4 Five-Day Reporting Requirement

Visible damage, shortages, incorrect products, missing components, and defects involving products without an express OMG Jump warranty must be reported in writing within five (5) calendar days after pickup or delivery.

The Buyer must provide proof of purchase and clear photographs or videos.

Failure to report within five days constitutes acceptance of the merchandise in its received condition, except where prohibited by law.

This deadline does not shorten the warranty period for a qualifying manufacturing defect covered under Section 7.

6.5 Damage After Release

OMG Jump is not responsible for damage occurring after release, including damage caused during loading, transportation arranged by the Buyer, unloading, storage, setup, installation, operation, rental, cleaning, maintenance, or use.

7. OMG JUMP LIMITED WARRANTY

7.1 Limited Warranty

The warranties in this section cover qualifying manufacturing defects only.

They do not cover damage, wear, or other conditions arising after manufacture.

7.2 Original Purchaser Only

Except where applicable law requires otherwise, OMG Jump warranties apply only to the original purchaser identified on the original OMG Jump invoice or receipt.

Warranty coverage is nontransferable and ends if the product is sold, resold, transferred, assigned, given away, or otherwise conveyed to another person or business.

7.3 Beginning of Coverage

Warranty coverage begins when the product is picked up from OMG Jump or delivered to the freight carrier for shipment, as reflected in OMG Jump’s records.

7.4 Inflatable Bounce Houses

Inflatable bounce houses manufactured or expressly warranted by OMG Jump include a two-year limited seam-to-seam warranty against qualifying manufacturing defects in the original seams and workmanship.

7.5 Water Slides and Inflatable Games

Water slides and inflatable games manufactured or expressly warranted by OMG Jump include a one-year limited warranty against qualifying manufacturing defects.

7.6 Inflatable Accessories

Zippers, mesh, entrance covers, slide mats, removable covers, and similar inflatable accessories include a ninety-day limited warranty against qualifying manufacturing defects unless a different written warranty is stated.

7.7 Chair Rivet Warranty

Plastic folding chairs, resin folding chairs, and Chiavari chairs include a one-year limited warranty covering qualifying manufacturing defects in the original rivets only.

The warranty does not cover frames, seats, backrests, feet, cushions, finishes, plastic, resin, wood, scratches, dents, discoloration, or hardware other than the covered rivets.

7.8 Table Rivet Warranty

OMG Jump 60-inch round plastic tables and 6-foot rectangular plastic tables include a one-year limited warranty covering qualifying manufacturing defects in the original rivets only.

The warranty does not cover tabletops, frames, legs, feet, locking mechanisms, plastic surfaces, scratches, dents, discoloration, warping caused after manufacture, or hardware other than the covered rivets.

7.9 Warranty Exclusions

The warranty does not cover:

• Normal wear and tear or cosmetic conditions that do not affect normal operation;

• Fading, staining, discoloration, printing or color variations, mold, mildew, odors, or improper cleaning;

• Cuts, punctures, tears, abrasions, burns, animal damage, accidents, impact, vandalism, or neglect;

• Improper setup, anchoring, transportation, storage, folding, maintenance, or operation;

• Overloading, dragging, dropping, misuse, abuse, rental abuse, or failure to follow instructions;

• Damage caused by weather, moisture, wind, rain, flooding, sunlight, heat, cold, fire, or chemicals; or

• Damage caused or worsened by unauthorized alterations, repairs, or replacement parts.

These exclusions apply to all covered products, including inflatables, chairs, and tables.

7.10 Repair-Only Remedy

To the fullest extent permitted by law, repair is the sole and exclusive remedy under an OMG Jump Limited Warranty.

OMG Jump does not provide refunds, product replacements, store credit, temporary replacements, rental reimbursement, or loaner products under its Limited Warranty.

7.11 Coverage and Repair Decisions

OMG Jump has the right to determine whether a condition qualifies as a manufacturing defect, whether an inspection is required, which component is covered, and the appropriate repair method, extent, and location.

7.12 Warranty-Claim Procedure

To submit a warranty claim, the Buyer must:

1. Contact OMG Jump within the applicable warranty period;

2. Provide the original invoice or receipt;

3. Provide photographs, videos, product information, and other reasonably requested evidence; and

4. Receive written authorization before returning or shipping the product.

Submitting information or merchandise for inspection does not mean the claim has been approved.

Unauthorized shipments or returns may be refused and returned at the Buyer’s expense.

7.13 Warranty Transportation Expenses

Except where applicable law requires otherwise, the Buyer is responsible for all expenses required to transport or ship the product to and from OMG Jump or another approved repair location.

OMG Jump does not pay or reimburse freight, shipping, packaging, palletizing, loading, unloading, insurance, handling, duties, or local transportation associated with warranty inspections or repairs.

7.14 Warranty After Repair

A repair does not create a new warranty or restart the original warranty period.

The repaired product remains covered for the unexpired portion of the original warranty, subject to any extension required by applicable law.

OMG Jump does not provide temporary or loaner products and is not responsible for lost rentals, income, customers, business interruption, or substitute-equipment costs during inspection or repair.

7.15 Blowers

Blowers are covered only by the original blower manufacturer’s warranty, if any.

OMG Jump does not provide an additional blower warranty or modify the manufacturer’s procedures, exclusions, warranty periods, or remedies.

7.16 Third-Party Products

Third-party products are covered only by the original manufacturer’s written warranty, if any.

OMG Jump does not adopt, extend, or provide an additional warranty for those products and does not guarantee that a manufacturer will approve a claim.

7.17 Products Without an OMG Jump Warranty

Except for the products and components specifically identified in this section, OMG Jump does not provide an additional express written warranty.

This includes, unless a separate written warranty is expressly provided, canopies, canopy tarps, backdrop equipment, portable bars, linens, decorations, balloons, helium equipment, accessories, replacement parts, print products, and other merchandise not listed above.

This provision does not eliminate rights that cannot legally be excluded or limited.

8. LIMITATION OF LIABILITY

8.1 Excluded Damages

To the fullest extent permitted by law, OMG Jump is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

This includes lost income, profits, rentals, opportunities, customers, event revenue, business interruption, substitute-equipment costs, labor expenses, travel expenses, or damage to other property.

8.2 Maximum Liability

To the fullest extent permitted by law, OMG Jump’s total liability relating to a product or order will not exceed the amount actually paid for the specific product giving rise to the claim.

8.3 Non-Waivable Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

9. TAXES, FEES, AND DUTIES

The Buyer is responsible for applicable sales taxes, use taxes, government fees, duties, assessments, and other charges associated with the purchase.

A Buyer claiming a resale or tax exemption must provide a valid and properly completed certificate before the transaction is completed.

The Buyer is responsible for taxes, penalties, interest, or costs resulting from an inaccurate, invalid, expired, or improperly used exemption certificate.

OMG Jump ships within the United States unless another arrangement is approved in writing.

10. INTELLECTUAL PROPERTY

OMG Jump’s logos, business names, product designs, photographs, videos, drawings, graphics, catalogs, advertising materials, and website content remain the property of OMG Jump or their respective owners.

The Buyer may not copy, modify, reproduce, distribute, sell, publish, or use OMG Jump intellectual property without written permission.

A Buyer reselling or renting OMG Jump products may use factual product information for legitimate advertising but may not represent that the Buyer is OMG Jump or an authorized OMG Jump representative.

11. BUYER RESPONSIBILITIES, SAFETY, AND INDEMNIFICATION

11.1 Inspection and Maintenance

The Buyer must inspect products before every setup, rental, event, or use.

Products showing damage, excessive wear, structural weakness, missing components, or unsafe conditions must not be used until properly evaluated and repaired.

11.2 Setup and Operation

The Buyer is responsible for proper transportation, unloading, setup, anchoring, installation, operation, supervision, cleaning, maintenance, storage, and removal.

11.3 Compliance

The Buyer is responsible for complying with applicable laws, regulations, permits, inspections, fire and building requirements, safety standards, manufacturer instructions, and local operating rules.

A Buyer renting products to others is also responsible for training employees and customers, providing safety instructions, supervising use when required, and maintaining appropriate inspection and maintenance records.

11.4 Indemnification

To the fullest extent permitted by law, the Buyer agrees to defend, indemnify, and hold harmless OMG Jump and its owners, officers, employees, and agents from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from the Buyer’s transportation, storage, setup, installation, operation, rental, resale, maintenance, modification, misuse, failure to supervise, failure to follow instructions, or violation of law.

This obligation does not apply to the extent a claim is finally determined to have resulted solely from OMG Jump’s non-waivable legal responsibility.

12. INSURANCE REQUIREMENT

The Buyer must maintain general liability insurance of at least $1,000,000 per occurrence covering all products purchased.

13. FINAL SALE, RETURNS, AND EXCHANGES

13.1 All Sales Final

All sales are final once merchandise is picked up, released, loaded into the Buyer’s vehicle, delivered locally, transferred to a freight carrier, or shipped.

OMG Jump does not accept returns or provide refunds or store credit because of buyer’s remorse, changed plans, ordering mistakes, incorrect quantities or measurements supplied by the Buyer, color or style preference, lack of use, insufficient storage, inability to obtain permits, inability to operate or rent the product, a customer cancellation, or a change in the Buyer’s business.

13.2 Damaged or Defective Merchandise

Merchandise that was damaged, defective, incorrect, or incomplete before release must be reported within the five-day period stated in Section 6.

If OMG Jump confirms that a product without an express OMG Jump warranty was damaged or defective when sold, OMG Jump may exchange the affected product or component.

An exchange is not available for damage occurring after release.

OMG Jump does not provide a cash refund when an approved exchange or another appropriate solution is available, except where required by law.

13.3 Transit Damage and Warranty Claims

Transit damage is handled under Section 5.

Manufacturing warranty claims are handled under Section 7.

No product may be returned, exchanged, shipped back, or dropped off without prior written authorization.

14. FORCE MAJEURE

OMG Jump is not responsible for delays or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, fires, floods, earthquakes, severe weather, epidemics, war, terrorism, civil unrest, labor disputes, port delays, transportation interruptions, government restrictions, material shortages, supplier failures, utility outages, equipment failures, or acts of God.

Such an event does not automatically cancel an order or make a deposit refundable.

OMG Jump may extend production or performance deadlines for a commercially reasonable period.

15. GOVERNING LAW AND VENUE

These Terms and all transactions between OMG Jump and the Buyer are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the fullest extent permitted by law, any action, lawsuit, or proceeding arising out of or relating to these Terms, an order, or a product purchased from OMG Jump must be brought exclusively in the state courts located in Los Angeles County, California, or, if federal subject-matter jurisdiction exists, in the United States District Court for the Central District of California.

The Buyer irrevocably consents to the personal jurisdiction and venue of those courts and waives any objection based on improper venue or inconvenient forum.

16. LEGAL FEES

In an action or proceeding arising from these Terms or an OMG Jump transaction, the prevailing party may recover reasonable attorneys’ fees and legal costs to the extent permitted by law.

17. SEVERABILITY AND WAIVER

If any provision of these Terms is found invalid, unlawful, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

OMG Jump’s failure or delay in enforcing a provision does not waive the right to enforce it later.

A waiver involving one order, customer, product, or situation does not constitute a waiver in another situation.

18. RIGHT TO REFUSE SERVICE

OMG Jump reserves the right to refuse service or cancel an order at its discretion, except where prohibited by law.

Any refund due following cancellation will be issued in accordance with these Terms and applicable law.
